Terms of use

Welcome to DailySong. By using the website, listening to the songs, ordering a song or joining the subscription, you agree to the terms on this page.

1. About the website

DailySong (dailysong.org) is a music venture by Romi Goldhamer. On the website you can listen to songs, order a personal birthday song and join the annual daily-song subscription.

2. Personal songs during the launch period

While the website is in its launch period, personal birthday songs are free. In return, people who order commit to sending Romi feedback on the song, good or bad, with the Feedback & requests button on the website, once they have received it.

Romi may end the launch period at any time. The end will be announced on the website, and orders received before then will be handled under the terms that applied when they were placed. Romi may decline an order, for example if the requested content is offensive.

3. The annual subscription

The annual subscription costs ₪30 a year and is paid with Bit. It includes a link to the daily song by WhatsApp or email and news from the venture, and does not include a personal song. The first 1,000 subscribers receive a founder certificate signed by Romi. Cancellations and refunds follow Israeli consumer protection law. To cancel, message Romi on WhatsApp or by email.

4. What you send us

When you send details, words or a photo for a song, you confirm that you are allowed to send them and that they don't infringe anyone else's rights. Romi uses them only to create the song and its cover.

5. How the songs are made

Romi uses AI tools, GPT and Gemini, as part of the creative process, and checks and edits every song himself before it goes out. Information about the people and events of each date comes from Wikipedia and may contain mistakes.

6. Personal use only

The songs, videos, lyrics, music and images on the website are for personal, private enjoyment. A personal song you order is meant to be sent to and shared with the person celebrating and their family and friends.

7. No commercial use

You may not use the songs or videos for commercial purposes without prior written permission. This includes ads, paid events, business pages, social media campaigns, products, services, monetized videos, performances and broadcasts. Businesses that want songs for their clients are welcome to contact Romi.

8. Copyright

All songs, videos, texts, images and design elements on the website belong to their owners and are protected by copyright. Using the website does not transfer any rights in the content to visitors.

9. Sharing

You may share links to the website for personal, non-commercial purposes, as long as you don't copy, download, edit, sell or re-upload the content or present it as your own.

10. Partnerships and collaborations

Requests to partner in the venture, collaborate or work on special projects go through the contact details on the website. Any such partnership or project is subject to a separate agreement between the parties.

11. External services and links

The website links to WhatsApp, Facebook, email and Bit. We are not responsible for the content, privacy policies or operation of external services.

12. Website availability

We try to keep the website available and working properly, but we can't guarantee it will always be free of errors, interruptions or technical issues.

13. Changes to these terms

These terms may be updated from time to time. Continuing to use the website after an update means you accept the updated terms.

Privacy policy

1. What we collect

When you order a song: the name of the person celebrating, their birthday, your relationship, the words you want in the song, the song's language, a cover photo (optional), your name and phone number. When you subscribe: your full name and WhatsApp number or email address. Feedback and requests go straight to Romi's WhatsApp and are not stored on the website.

2. How we use it

Only to create and send your song, manage your subscription, send your certificate and get back to you. We don't send you marketing without your consent.

3. Where it is stored

Form submissions are stored with Netlify, which hosts the website, and emailed to Romi. Only Romi, and whoever helps him maintain the website, can see them.

4. Sharing

We don't sell or rent personal information. Information is shared only when needed to handle your request or when the law requires it.

5. Cookies

The website doesn't use advertising or tracking cookies. Your browser stores only a small technical note, for example that you've already seen the "Tap to open" hint. Fonts are loaded from Google Fonts.

6. Your rights

You can ask to see, correct or delete the information you gave us, under Israeli privacy law. Message Romi on WhatsApp or by email.

7. Security

We take reasonable steps to protect information, but no online system is completely secure.

Accessibility statement

We want everyone to be able to use the website comfortably. It was built following common accessibility guidelines (WCAG) as far as possible:

• Full keyboard navigation and a "Skip to content" link at the top of the page
• Alt text for images and labels for every form field
• Readable color contrast and comfortable font sizes
• Layouts for phone, tablet and desktop
• Animations turned off for people who set "reduce motion" on their device

Some parts of the website, like the song player and the calendar, may not be fully accessible yet. We keep improving.
